Who should give Zakat
The obligation of Zakat is compulsory on every Muslim who owns Nisaab minimum, if the person is a man, woman, young, healthy old or insane. Because the proof of Zakat Al-Quran and Sunnah is general and does not exclude young or insane. Allah (SWT) said: “Of their goods take alms so that you purify and sanctify them more powerful …” (Al-Qur’an, 9: 103)
Imam Ibn Hazim said that every Muslim must be young or old sane or insane to purify his wealth with Zakat because of the generality of the evidence. Anas bin Malik reported that the Messenger of Allah (saws) said. “Trade with the money of the orphan, because it is not absorbed by the Zakat” (At-Tabraani) In another Hadith `Amru bin Shuaib related from his grandfather the Messenger of Allah said:
“Whoever is entrusted with money of an orphan should trade with it and must not leave it sitting to be used by the charity.” (Tirmidhi)
The reference point in these reports is that the Messenger (saws) urged the trustee of the estate of people who due to age or other reasons can not manage their financial affairs, to invest in a business that will yield a return and make it grow until they are able to do so themselves. In fact, if the investment is not made properly with the legacy of a ophan, will be depleted by charity, thus leaving the orphan with little or nothing.
