Law Of Respecting Flag

Shaykh Abdul-Muhsin ibn Nasir Alu Ubaikan (one of the clerics in the Kingdom of Saudi Arabia) said,

Among the contemporary issues that need to be explored with a careful understanding of the problems that arose in this period associated with respect for the country and its systems as well as respect for state symbols. That’s the flag salute issue.

What is meant by respect for the flag here is to stand in honor of the flag. Some people have talked about the legal problem without judging by looking at the root of the problem and the proper juristic analysis. As a result, they passed a law that is inconsistent with the reality on the ground and not in accordance with the intent or purpose of those who give respect for the flag.

If we look, the flag was originally the object surrounded by the forces of war and warfare conducted under kibarannya. So the battle flag is a symbol of the establishment of a warlord Leadership so the fall of the flag of war means losing the war. At this time the flag was a symbol of a country that was raised at various momentum. By respecting the flag means respecting the leadership of heads of state.

Similarly, we need to consider the condition of those who paid tribute to the flag. The reality is they are not respecting the type of fabric which become the flag-making material, but they respect the country that the flag is a symbol.

Scholars who argue that the flag salute was heresy means that people who give respect for the flag to worship God in this way the flag salute. This is the meaning of heresy in Shari’a law. But we did not encounter anyone who intends so as to give respect for the flag.

If there are people who say that in respect for the flag there is a celebration of the flag itself as the celebration of something that is worshiped. It is beyond doubt that it is polytheism to Allah but we do not know anyone who do it.

By examining the ‘gods, or because the law which could serve as the basis of assessment in this matter is very clear that people who pay homage to the flag was not intended by the intentions above. But the intent of respect is respect for the state flag and state symbols.

Associated with the flag of the Kingdom of Saudi Arabia, the flag contains the words of monotheism (laa ilaha illallah) that must be respected by every Muslim.

One thing that we all know, in respect of Shari’a law if the creature was not such a respect for God is permissible. The evidence for when the Prophet sallallaahu ‘alaihi wa sallam sent a letter to Heraclius in his letter the Prophet said, “From Muhammad the Messenger of God to Heraclius one that is respected by the Romans”. When Saad bin Muadh it comes to punishing the Jews of Bani Quraizhah Prophet said, “Stand O ‘Ansar-you-to your leader”.

Standing to honor people who come are regular tribute, not a homage to the level of servitude. So that the stand is not up to the level of exaltation as glorifying to God. Tribute such as this is permissible given to the creature as the arguments over “.

Text fatwa:

فإن من النوازل التي تحتاج إلى فقه دقيق هي ما ظهر في هذا الزمن من مسألة تتعلق باحترام الدولة ونظامها وتعظيم رمزها ألا وهي تحية العلم, والمقصود القيام تعظيما للعلم وقد تكلم البعض في هذه المسألة من غير تأصيل ولا تكييف فقهي فأصدروا أحكاما لها لا تتوافق مع الواقع المحسوس ولا مع ما يقصده من يأتي بالتحية وإذا نظرنا إلى أن العلم أو اللواء في الأصل هو ما تلتف حوله الجيوش وتخاض تحته الحروب فكان رمزا للقيادة وبسقوطه تحصل الهزيمة, وفي هذا الزمن أصبح العلم هو شعار الدولة فيرفع في المناسبات ويحصل بتعظيمه تعظيم القيادة, وإذا نظرنا إلى حال الذين يقومون بتحية العلم وجدنا أنهم لا يعظمون نوع القماش الذي صنع منه العلم وإنما يعظمون ما هو شعار له, فمن قال من العلماء إن تحية العلم بدعة فإنه يلزم من حكمه أن يكون المحيي للعلم متعبدا لله عز وجل بهذه الوسيلة التي هي تحية العلم وهذا معنى البدعة في الشريعة ولا نجد أحدا يقصد بالتحية هذا المعنى, ولو قال قائل إنه بهذه التحية يعظم نفس العلم تعظيم عبادة فهذا ولا شك شرك بالله عز وجل لا نعلم أحدا فعله, وبتحقيق المناط يتضح جليا أن الذي يحيي العلم لا يقصد ما تقدم ذكره وإنما يقصد تعظيم الدولة ورمزها, وبالنسبة لعلم المملكة العربية السعودية فهو يحوي كلمة التوحيد والتي يجب تعظيمها من كل مسلم, ومن المعلوم شرعا أن تعظيم المخلوق إذا لم يكن من باب تعظيم الخالق عز وجل فهو جائز كما فعل صلى الله عليه وسلم عندما كتب إلى هرقل فقال (من محمد رسول الله إلى هرقل عظيم الروم), وقال عندما أقبل سعد بن معاذ رضي الله عنه ليقضي في بني قريظة (قوموا إلى سيدكم) و (القيام تعظيم للقادم تعظيم عادة لا تعظيم عبادة) فهو لا يرتقي إلى درجة تعظيم الخالق وهذا سائغ في حق المخلوق كما جاءت به الأدلة والله أعلم وصلى الله وسلم على نبينا محمد وآله وصحبه.
